Refund & Cancellation Policy

This policy governs refunds and cancellations for all paid services provided by Brand Bakery. We believe in fair, transparent terms and want every client to feel confident engaging with us. This policy is in addition to any specific terms outlined in your individual Service Agreement or Statement of Work (SOW).

1. Scope

This Refund & Cancellation Policy applies to all paid services offered by Brand Bakery, including but not limited to:

  • Brand identity and design projects
  • Product design and web/app development
  • AI-integrated experience projects
  • Digital marketing and SEO campaigns
  • Ongoing retainer engagements

This policy does not apply to our free tools, which carry no charge and therefore no refund or cancellation mechanism.

2. Project Cancellation

2.1 Cancellation Before Work Commences

If you cancel your project before Brand Bakery has commenced any billable work (no design files opened, no development environment set up, no research initiated), the following applies:

  • Advance payments (retainers) will be refunded in full, minus a processing fee of ₹2,000 (or the actual payment gateway charge, whichever is higher) to cover banking and administrative costs.
  • Refund will be processed within 7–14 business days via the original payment method.

2.2 Cancellation After Work Has Commenced

Once Brand Bakery has started work on your project, fees are calculated on a milestone or time-spent basis:

  • Milestone-based projects: Completed milestones (as defined in your SOW) are non-refundable. You will be invoiced for work completed up to the cancellation date, and any remaining advance beyond that amount will be refunded.
  • Time & materials projects: Hours already logged and billed are non-refundable. Any pre-paid hours not yet used will be refunded.
  • Design deliverables already shared: If design files, prototypes, code, or reports have been delivered to you (even in draft form), the associated milestone fee is non-refundable.

2.3 Cancellation of Retainer Engagements

Monthly retainer engagements may be cancelled by either party with a minimum of 30 days’ written notice.

  • Retainer fees already paid for the current billing month are non-refundable.
  • Any pre-paid months beyond the notice period will be refunded pro-rata, based on unused days.
  • Notice must be sent in writing to support@brandbakery.tech with the subject line “Retainer Cancellation Notice”.

3. Refund Eligibility

Refunds are available in the following situations:

  • Pre-commencement cancellation: As described in Section 2.1 above.
  • Duplicate payment: If you are charged twice for the same invoice due to a technical error, the duplicate amount will be refunded in full within 7 business days of our confirming the error.
  • Overcharge: If you are charged more than the agreed amount in your SOW due to a billing error, the excess will be refunded within 7 business days of our confirming the discrepancy.
  • Service not delivered: If Brand Bakery fails to deliver agreed services within a materially unreasonable timeframe through no fault of the client, and you have raised a formal complaint that we have been unable to resolve within 30 days, you may be entitled to a partial or full refund for undelivered work, assessed on a case-by-case basis.

4. Non-Refundable Items

The following are explicitly non-refundable:

  • Fees for completed and delivered milestones or deliverables, regardless of your satisfaction with the creative direction (as long as the work meets the agreed brief).
  • Third-party costs paid on your behalf, such as domain registration fees, stock asset purchases, advertising spend, software licences, or cloud infrastructure provisioned for your project.
  • Rush or expedited fees charged for fast-tracked deliveries.
  • Fees for revision rounds already completed beyond the scope agreed in your SOW.
  • Retainer fees for the current active billing month at the time of cancellation.

5. How to Request a Refund or Cancellation

To initiate a cancellation or refund request:

  1. Email support@brandbakery.tech with the subject line “Refund Request” or “Cancellation Request”.
  2. Include your full name, company name, invoice number(s), and a brief description of the reason for the request.
  3. Our team will acknowledge your request within 2 business days and provide a resolution or further information within 10 business days.

Refund requests submitted more than 30 days after the relevant invoice date will not be considered, except in cases of duplicate payment or verifiable billing errors.

6. Refund Processing

  • Approved refunds are processed within 7–14 business days.
  • Refunds are issued via the same payment method used for the original transaction (bank transfer, UPI, or card). If the original method is unavailable, we will coordinate an alternative with you.
  • Payment gateway processing fees (typically 2–3%) are deducted from refund amounts where applicable, as these fees are non-recoverable from the payment gateway.
  • Refunds are issued in Indian Rupees (INR) at the original exchange rate. We are not responsible for currency fluctuations for international clients.

7. Project Pause

Instead of cancelling a project, you may request to pause it for up to 60 days (subject to our team’s availability). After 60 days of inactivity without communication, Brand Bakery reserves the right to close the project and treat the outstanding balance as earned for work completed to date.

To pause a project, notify us in writing at support@brandbakery.tech.

8. Dispute Resolution

We take client satisfaction seriously. If you are dissatisfied with an outcome or believe you are entitled to a refund not covered above, please reach out and we will work in good faith to find a fair resolution.

Unresolved disputes are subject to the governing law and dispute resolution process outlined in our Terms of Service.

9. Consumer Rights

Nothing in this policy limits your rights under the Consumer Protection Act, 2019 (India) or other applicable consumer protection legislation. If you are a consumer (not a business) engaging Brand Bakery for personal services, your statutory rights are unaffected by this policy.
